These terms and conditions (the "Terms and Conditions") describe the terms and conditions governing your use of www.rightontrackcareers.com (the “Site”), and any and all services, data, software, applications and tools (collectively, the “Services”) provided by Right On Track Careers Inc. (the “Company”). In these Terms and Conditions, ‘we’, ‘us’, and ‘our’ refers to rightontrackcareers.com and its owner Right On Track Careers Inc. 

The material appearing on the Site is provided as either information about Right On Track Careers’ events, people, courses, programmes and stories, or as a platform for online connection and community. Right On Track Careers Inc. and its directors, agents, employees and affiliates assume no responsibility or liability for any consequences resulting directly or indirectly from any action or inaction you take based on the information found on or material linked to on this Site.

By using this Site, you accept and agree that following any information or recommendations provided therein is at your own risk.

Please read carefully! The following Terms and Conditions form a binding agreement (“Agreement”) between you and Right On Track Careers Inc. Your access to and use of this Site is subject to legally binding Terms and Conditions, which you accept and agree to by accessing this Site. The Company may modify, amend, supplement and replace these Terms and Conditions at any time without advance notice. Your continued use of this Site after any change means you have accepted the changed Terms and Conditions.

1. Copyright 

All content published and made available on our Site is the property of Right On Track Careers Inc. and the Site's creators. This includes, but is not limited to images, videos, text, logos, documents, downloadable files and anything that contributes to the composition of our Site. The absence of a registered copyright symbol does not mean that such materials are not protected as belonging to the Company.

This protection extends worldwide, and any person found to be fully or partially using the Company’s graphics, text found anywhere across email, website or social media, or content including PDF and Google Docs guides, private coaching and course materials, will be deemed guilty of copyright infringement and becomes eligible for legal pursuit.

2. Intellectual Property Ownership

If we have materials on the Site, which you can download, a revocable, non-exclusive license is granted for you to download copies of the materials for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• modify or copy the materials;
• use the materials for any commercial purpose, or for any public display (commercial or non-commercial); or
• transfer the materials to another person or “mirror” the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by the Company at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

If the Company discovers that you have illegally misappropriated or used any of the intellectual property you were granted access to, you will be blacklisted from any future programmes. You also agree to reimburse the Company for any damage, loss, cost or expense the Company incurs (including fees or costs of attorneys, accountants, professional advisors, and other experts incurred in connection with the defense or settlement of the foregoing) because of your use of the materials or Services for any unlawful or prohibited purpose.

If you are a current or aspiring Career Coach, Resume Writer or careers professional who has purchased any of our paid Services, it will be assumed that it was to access our intellectual property and use it for your own professional gain, resulting in an instant blacklisting of your profile and revoking of all access rights without refund.

If the core idea from any Right On Track Careers materials are found to be replicated in any way, even if translated into another language, you will be deemed liable for legal action against you for copyright infringement.

3. Invited Submissions

From time to time, areas on this Site may expressly request submissions of ideas or improvements through promotions, surveys or otherwise (“Invited Submissions”). Where this is the case, please carefully read any specific rules or other terms and conditions which appear elsewhere on this Site to govern those submissions (“Additional Terms”), as they will affect your legal rights. If no Additional Terms govern those submissions, then these Terms and Conditions will apply in full to any Invited Submissions you make. In any event, any material you send to us will not be treated as confidential. Regardless of any industry custom or practice, we will not pay you for the use of any content or submissions that you submit to the Site.

If you provide Invited Submissions, you grant the Company a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable, and fully sub-licensable right to use, reproduce, publish, distribute, publicly display, publicly perform, translate, adapt, modify, telecommunicate, rent out, commercialize, monetize, and create derivative works from the Invited Submissions in any way and for any purpose without providing any compensation to you or any other person. You also grant the Company the right to use the name you submit with Invited Submissions, if any, in connection with the Company’s rights hereunder.

4. Links to Third Party Websites

This Site may contain links to third party websites. All such linked sites, materials and pages are not under the control of the Company. The Company is not responsible for the content contained in any linked website nor for any losses or damages you may incur as a result of the use of any such website. The Company accepts no liability for any errors or omissions contained in third party websites. These links are provided to improve your use of the Site, enable you to connect with Right On Track Careers on various platforms, and conduct transactions with Right On Track Careers Inc.

5. No Guarantees

We make NO GUARANTEES about any success that you’ll get from our Site or our programmes, coaching or courses or any of our free offers. Client testimonials are for information and inspiration purposes only. You understand that the Company makes no guarantees whatsoever regarding any results based on any action or inaction relating to your life, social media accounts, career or finances based on the information we share or Services we sell or share for free through the Site. At the end of the day, we will not be responsible or make any promises for what will happen in your life, career and financial situation. Even if you’ve worked with us as a client before and had certain results, we make no guarantee that will happen again. We care deeply about your success, but we make no promises regarding results and make no guarantees whatsoever.

6. Updates to Terms and Conditions

The Company reserves the right to change its Terms and Conditions at any time. Please note that these Terms and Conditions may be revised and reissued, with changes taking effect immediately when posted on the Site. You consent and agree to receive notices of updates of these Terms and Conditions through our posting of updated Terms and Conditions on the Site. You should visit this page regularly to review the current terms. Your continued use of the Site and/or Services after any change of these Terms and Conditions constitutes your acceptance of such changes and your agreement to be bound by these Terms and Conditions. If you do not agree to any of the changes, your sole remedy shall be to discontinue use of the Site and/or Services.

Right On Track Careers Inc. and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of the use or inability to view or use the materials or content on the Site. 

8. Indemnity

As a condition of your use of the Site, you indemnify and hold harmless Right On Track Careers Inc. and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

9. Governing Law

These Terms and Conditions are governed by the laws of the Province of Ontario.

10. Inappropriate Conduct

Right On Track Careers Inc. fully reserves the right to remove, block, and delete your access to their social media accounts, groups, courses and programs in response to inappropriate conduct, including but not limited to: abusive, hateful or offensive comments, remarks of a sexual nature, or causing discomfort to the team or fellow students in any other way. You will not be refunded following the removal of a program or course for this reason.

11. Entire Agreement

These Terms and Conditions and any other legal notices, policies and guidelines of Right On Track Careers Inc. linked to these Terms and Conditions or contained on this Site constitutes the entire Agreement between you and Right On Track Careers Inc. relating to your use of this Site and supersedes any prior understandings or agreements (whether oral or written), claims, representations, and understandings of the parties regarding such subject matter. This Agreement may not be amended or modified except by Right On Track Careers Inc.
